IHC Declares Parts Of Golf Course Invaded, Orders Sealing Of Monal Restaurant

Monal restaurant has always been the famous spot for tourist and inhabitants of Islamabad to enjoy the beautiful nature around while having delicious meal. The location is so perfect and attractive and we haven’t seen this place empty. But nobody has ever noticed that this beautiful restaurant and Margalla Greens Golf Club has built on illegal land.

Today, on Tuesday 11th of January 2022, Islamabad High Court (IHS) has declared to seal Monal and the Golf Course because it is built on encroached property by arm forces. IHS Chief Justice Athar Minallah asked capital authorities to take over the Margalla Golf club spread over 8,000 acres of land. It is declared that the areas occupied by a restaurant at the Margalla Hills Golf Course in the capital as part of a national park.

Justice Athar Minallah stated that the property belonged to the federal government’s Military Farms directorate and directed to seal off all illegal spots on the property or face contempt proceedings. He further said that any claims regarding ownership of land in Margalla Hills National Park were false; this is Federal Government’s land and no one can claim ownership over it.

Those who came to express their support for the INRs included Military Farms directorate additional director general Lt Gen Aamir Khan and former envoys Rustam Shah Mohmand and Abdul Karim Akhund.

One of the petitioners, environmentalist Abdul Aziz, specifically mentioned Monal and the golf courses it owns on a lease with the federal government. The CDA has asked to show lease document and the time period mentioned on that.

“No one is above the law”, said by the judge.

In a landmark decision, the Islamabad High Court ordered sealing of monal restaurant built in its jurisdiction. The court also directed the strategic federal agency to submit a report on the damages caused by illegal constructions.
